Bail granted to journalist Prashant Kanojia by Allahabad High Court.

We feel delighted to share that Adv. Surangama Sharma, Senior Partner, S&D Legal Associates achieved huge success as Allahabad High Court (Lucknow Bench) granted bail to journalist Prashant Kanojia in a case where he was dragged behind bars by the Uttar Pradesh police in August 2020 for allegedly posting morphed tweet related to the Ram Mandir in Ayodhya. The bail application was filed and argued by Adv. Sharma.


An FIR was registered at the Hazratganj Police Station alleging that Kanojia had tweeted a morphed photo of a social media post made by Hindu Army leader Sushil Tiwari to promote enmity between two or more communities.


Taking actions on behalf of FIR registered, Uttar Pradesh police arrested him from his residence in Delhi. During the last hearing, the High Court had granted four weeks time to the state government to file its reply in the bail plea moved by the journalist.


The bail application was vehemently opposed on behalf of the State Government, however, Adv. Sharma was able to prove that there was no possibility of the applicant tampering with the evidence or influencing the investigation in any manner. She also apprised before the Court that the accused person was a journalist and never had any type of criminal history. The Hon'ble Court after taking note of the above facts and circumstances observed that a case for grant of bail is made out and ultimately released Mr. Khan on bail vide an order dated 21.10.2020.
