Relief from Arrest: Allahabad High Court Protects Petitioner from Coercive Action: Read Order

Understanding the Case


Recently, the Allahabad High Court granted important interim protection in a matter where a criminal dispute appeared to have its roots in a business rivalry rather than genuine criminal conduct. The case revolved around an FIR registered in Saharanpur under Sections 420, 467, 468, and 471 of the IPC.


The petitioner, a law-abiding businessman engaged in the export of generic medicines, had approached the High Court under Article 226 of the Constitution. He sought quashing of the FIR and relief from arrest, pointing out that what was essentially a commercial disagreement was being given a colour of criminality.


The Background


The FIR alleged cheating and forgery on the part of certain individuals involved in the export of pharmaceutical consignments. However, the petitioner clarified that he was not even named in the original FIR, and his implication came much later—after a significant delay of over 500 days.


This raised serious questions about the bona fides of the allegations. According to the pleadings, the case stemmed more from competition and personal grudge between two business entities rather than any actual offence.


Observations of the Court


After hearing the matter, the Hon’ble Bench comprising Justice Siddhartha Varma and Justice Abdul Shahid observed that:

  • At first glance, the FIR seemed to transform a civil or commercial dispute into a criminal case.

  • The issues raised were better suited for resolution through civil proceedings.

  • The matter required deeper consideration, and notices were accordingly issued to the parties.

Most importantly, the Court granted interim relief by directing that the petitioner shall not be arrested until the next date of hearing or until submission of the police report, whichever is earlier.

This interim protection is significant because:

  • It prevents arbitrary arrest in cases where business disputes are dressed up as criminal allegations.

  • It underscores that criminal law cannot be misused to settle commercial rivalries.

  • It reiterates the principle that civil remedies must be pursued for civil disputes, rather than invoking harsh criminal provisions.


Looking Ahead


The matter will now proceed for further hearing after counter and rejoinder affidavits are filed. The interim protection ensures that the petitioner can present his case without fear of coercive police action.
